Spitzer: resignation procedure

If the Governor decides to resign, here is the process:

Under Public Officers Law section 31 (1) (a) the governor may resign to the legislature.  The resignation shall be in writing and addressed to the officer or body to whom it is made (section 2).  Resignations addressed to the legislature . . . shall be delivered to and filed with the secretary of state (section 3).  Resignations may not be withdrawn, cancelled, or amended except by consent of the officer or body to whom it was made (section 4).
