Filling Senator Clinton’s vacancy

NY Senator Hillary Clinton was appointed Secretary of State by President-Elect Barack Obama.  There has been much speculation about who Governor Paterson will choose to fill Senator Clinton’s vacancy and little about what authority the Governor has to do so. 

According to the Public Officers Law, section 42, 4-a “if a vacancy occurs in the office of a US Senator from this state in any even numbered calendar year on or after the 59th day prior to the annual primary election, or thereafter during said even numbered year, the governor shall make a temporary appointment to fill such vacancy until the 3rd day of January in the year following the next even numbered calendar year.”
